On January 14, 2022, the Centers for Medicare and Medicaid Services (CMS) issued guidance for the implementation of the Interim Final Rule – Medicare and Medicaid Programs; Omnibus COVID-19 Health Care Staff Vaccination, following the Supreme Court ruling lifting the injunction for 24 states listed in the Louisiana and Missouri lawsuits.
CMS has also prepared guidance for hospice providers.
Health care workers in the 24 states listed below that fell under the federal court injunctions prior to the Supreme Court’s opinion will have 30 days, or until February 14, 2022, to get their first shot. (NOTE: If 30 days falls on a weekend (February 13, 2022) or designated federal holiday, CMS will use enforcement discretion to initiate compliance assessments the next business day.) The 60 day deadline to be fully vaccinated is March 15, 2022.
